Donald Trump attempt to reinstate US travel ban fails
A US appeals court has denied an emergency appeal from the Department of Justice to reinstate President Donald Trump’s temporary ban on refugees and travellers from seven majority-Muslim countries.
“Appellants’ request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied,” the ruling by the US Court of Appeals for the Ninth Circuit said early on Sunday.
The court ruling can be seen as a further blow to Mr Trump, with the legal battle likely to continue for days.
Late on Saturday the justice department had filed an appeal against what Mr Trump called a “ridiculous” order from a federal judge, which had temporarily halted his ban. It said that the judge in Seattle had over-reached by “second-guessing” the president on a matter of national security.
The higher court’s denial of the administration’s request means people affected by the ban can, for now, continue to travel. The higher court asked challengers of the ban to respond and for the justice department to file a counter-response on Monday.
Tension between the president and the judiciary has risen as the battle over his ban has stepped up. Mr Trump returned to Twitter repeatedly to lash out at the “so-called judge” in Washington state who suspended the travel ban, and warn that his decision was endangering the country.
